Federal Judge Rules Case Against GM Involving Ignition Switch Defect Should Remain in Cobb County State Court

This products liability case arises out of a defective ignition switch design and manufacture by General Motors, which resulted in the death of Brooke Melton. After GM induced a settlement, the parents of Brooke learned that GM had concealed relevant evidence and sought to rescind the settlement (and return any benefits received under same) in the State Court of Cobb County. GM then attempted to remove the case to Federal Court, and Judge Thrash ruled that removal to Federal Court was improper. The State Court was remanded the case for further action on the merits of the Meltons’ rescission claim.
